1. INTRODUCTION

These Terms & Conditions (“Terms”, “Terms and Conditions”, “Agreement”) govern the access and use of bharatkashiyatra.com and the booking, purchase and use of tour, travel, cab, sightseeing, airport transfer, railway-station transfer, outstation transportation, pilgrimage and other travel-related services offered or arranged by Bharat Kashi Yatra (“Bharat Kashi Yatra”, “we”, “us”, “our”).

By accessing our website, submitting an enquiry, requesting a quotation, communicating with us through telephone, WhatsApp or email, making a booking, making a payment, or using any service arranged by us, you acknowledge that you have read and understood these Terms and agree to be bound by the applicable provisions.

If you do not agree with these Terms, please do not use the website or proceed with a booking.

These Terms shall be read together with the applicable quotation, booking confirmation, invoice, itinerary, cancellation/refund conditions and any specific written conditions communicated for a particular booking.


2. ABOUT BHARAT KASHI YATRA

Bharat Kashi Yatra is a Varanasi-based tour and travel service provider offering, subject to availability and the particular booking:

  • Varanasi sightseeing;
  • religious and pilgrimage tours;
  • domestic tour packages;
  • customized tour packages;
  • local sightseeing;
  • airport pickup and drop;
  • railway-station transfers;
  • local cab services;
  • outstation cab services;
  • intercity transportation;
  • tourist transportation;
  • group travel arrangements; and
  • other related travel services.

Certain services may be provided directly by Bharat Kashi Yatra and/or through independent drivers, vehicle owners, transport operators, hotels, guides, activity providers or other third-party service providers.

The exact nature of the service applicable to a particular customer shall be determined by the booking confirmation.


3. DEFINITIONS

For these Terms:

“Customer”, “you” or “your” means the person making an enquiry, booking, payment or using the services.

“Bharat Kashi Yatra”, “we”, “us” or “our” means the business operating under the Bharat Kashi Yatra name.

“Services” means tours, travel arrangements, cab services, sightseeing, transfers, transportation and other travel-related services offered or arranged by us.

“Booking” means a reservation accepted and confirmed by Bharat Kashi Yatra.

“Service Provider” means any driver, vehicle owner, transport operator, hotel, guide, activity provider, payment provider or other third party involved in fulfilling a booking.

“Booking Confirmation” means the written or electronic confirmation issued or communicated by Bharat Kashi Yatra containing the applicable booking details.


4. WEBSITE USE

You agree to use this website only for lawful purposes.

You must not:

  • submit false or misleading information;
  • make fraudulent or fictitious bookings;
  • impersonate another person;
  • use another person’s personal information without authorisation;
  • attempt unauthorised access to the website or its systems;
  • interfere with website security;
  • introduce malware, malicious code or harmful software;
  • scrape, copy or commercially exploit website content without permission;
  • use the website for unlawful activities;
  • attempt to manipulate prices, bookings, reviews or payment systems; or
  • use the website in any manner that violates applicable Indian law.

We reserve the right to restrict or suspend access where reasonably necessary to protect our website, customers, service providers, systems or legitimate business interests.


5. ENQUIRY DOES NOT AUTOMATICALLY CONSTITUTE A BOOKING

Submitting an enquiry through the website, telephone, WhatsApp, email or any other communication channel does not automatically create a confirmed booking.

A booking shall generally become confirmed only when:

  1. the requested service is available;
  2. the applicable price and material conditions have been communicated;
  3. the customer accepts the applicable booking terms; and
  4. the required advance/payment or other confirmation requirement has been completed.

An enquiry, quotation or availability indication may change before confirmation due to availability, supplier pricing, seasonal demand, operational circumstances or other legitimate reasons.


6. ACCURACY OF CUSTOMER INFORMATION

The customer is responsible for providing accurate and complete information necessary for the booking.

Depending upon the service, this may include:

  • passenger name;
  • mobile number;
  • WhatsApp number;
  • email address;
  • travel date;
  • pickup location;
  • drop location;
  • number of passengers;
  • luggage information;
  • flight details;
  • train details;
  • hotel information;
  • sightseeing requirements;
  • special requirements; and
  • other information reasonably necessary for providing the service.

Incorrect or incomplete information may result in delays, additional charges, inability to provide a requested service or other operational consequences.

Where the customer supplies information on behalf of another traveller, the customer should have appropriate authority to provide that information.


7. PRICES AND QUOTATIONS

The price applicable to a particular booking shall be the price communicated and accepted for that booking, subject to the stated inclusions and exclusions.

Depending on the service, additional charges may apply for items such as:

  • applicable taxes;
  • tolls;
  • parking;
  • state entry tax;
  • permits;
  • additional kilometres;
  • additional hours;
  • waiting time;
  • route deviation;
  • extra sightseeing;
  • entry tickets;
  • guide services;
  • boat services;
  • accommodation;
  • meals;
  • special arrangements; or
  • other services specifically requested by the customer.

Where reasonably foreseeable, applicable charges will be disclosed before confirmation.

Website prices, advertisements and promotional prices may be subject to availability and specific conditions.


8. PAYMENT TERMS

Payment requirements may vary according to:

  • type of vehicle;
  • tour package;
  • travel date;
  • season;
  • destination;
  • accommodation;
  • supplier requirements; and
  • the particular booking.

A booking may require full payment, partial advance payment or another payment arrangement specified in the quotation or booking confirmation.

The customer’s booking may remain unconfirmed until the required payment or confirmation requirement is completed.

Where payment is processed through a third-party payment provider, the payment provider’s applicable terms and security procedures may also apply.


9. PAYMENT RECEIPTS AND BOOKING RECORDS

Customers should retain:

  • payment receipts;
  • booking confirmations;
  • invoices;
  • quotation messages;
  • cancellation confirmations; and
  • other relevant booking communications.

Customers are encouraged to verify the booking details immediately after receiving the confirmation and notify Bharat Kashi Yatra promptly if any material error is identified.


10. CANCELLATION BY CUSTOMER

Cancellation terms may vary depending upon:

  • type of service;
  • vehicle;
  • tour package;
  • travel date;
  • time remaining before travel;
  • hotel or supplier conditions;
  • tickets or permits already purchased;
  • non-refundable third-party charges; and
  • the specific cancellation policy communicated for the booking.

The cancellation and refund terms applicable to the customer’s particular booking shall be communicated before or at the time of confirmation wherever applicable.

Any cancellation charge should be proportionate to the applicable contractual and actual service commitments and shall remain subject to applicable consumer law.

No cancellation provision shall be interpreted as removing a refund or remedy that the customer is mandatorily entitled to under applicable law.


11. REFUND POLICY

Where a refund becomes payable, the refundable amount shall be determined according to:

  • the applicable booking terms;
  • services already consumed;
  • legitimate cancellation charges;
  • non-refundable amounts actually committed to third-party suppliers;
  • applicable taxes or statutory charges; and
  • applicable law.

Where a refund is approved, it may be processed through the original payment method or another lawful method agreed between the parties.

Processing time may depend upon the payment gateway, bank, payment provider or third-party supplier involved.

Nothing in these Terms shall be interpreted as authorising an unlawful forfeiture of a customer’s money.


12. CANCELLATION OR MODIFICATION BY BHARAT KASHI YATRA

Bharat Kashi Yatra may cancel, modify or reschedule a service where reasonably necessary because of circumstances including:

  • vehicle breakdown;
  • vehicle unavailability;
  • driver unavailability;
  • safety concerns;
  • severe weather;
  • natural disaster;
  • road closure;
  • government restrictions;
  • law-and-order conditions;
  • strikes;
  • accidents;
  • supplier failure;
  • operational impossibility;
  • force majeure events; or
  • other circumstances beyond reasonable control.

Where a service is cancelled by Bharat Kashi Yatra and the customer is legally entitled to a refund, the applicable refund or other remedy shall be provided according to the booking terms and applicable law.


13. VEHICLE AND CAB SERVICES

Cab and transportation services are subject to:

  • applicable motor vehicle laws;
  • permit requirements;
  • registration requirements;
  • fitness requirements;
  • insurance requirements;
  • driver licensing requirements;
  • passenger capacity;
  • road conditions;
  • traffic restrictions;
  • state and local transport regulations; and
  • lawful instructions issued by competent authorities.

Commercial transport vehicles shall be operated subject to applicable legal requirements.

The Motor Vehicles Act, 1988 contains the statutory framework concerning permits and transport vehicles, including the requirement concerning use of transport vehicles in accordance with applicable permits.


14. DRIVER SAFETY AND LEGAL COMPLIANCE

Customers must not request, pressure or instruct a driver to:

  • drive dangerously;
  • exceed lawful passenger capacity;
  • exceed lawful speed limits;
  • drive while medically or otherwise unfit;
  • violate traffic rules;
  • operate without legally required documents;
  • use an unauthorised vehicle;
  • carry prohibited goods; or
  • otherwise violate applicable law.

A driver may refuse an instruction that would create a safety risk or require violation of law.


15. VEHICLE SUBSTITUTION

Where reasonably necessary due to operational circumstances, the vehicle originally indicated may be replaced with another vehicle of the same or reasonably comparable category, subject to availability.

Where a material downgrade occurs, the customer may raise the issue with Bharat Kashi Yatra for appropriate resolution.

Nothing in this clause authorises an arbitrary or misleading substitution.


16. PASSENGER CAPACITY

The number of passengers must not exceed the legally permissible seating capacity of the vehicle.

The customer must provide accurate passenger information before booking.

If the actual number of passengers exceeds the confirmed capacity, Bharat Kashi Yatra may require an additional vehicle or another lawful arrangement.

Any additional cost arising from a customer-requested additional vehicle or service may be payable by the customer after being communicated.


17. LUGGAGE

Customers should disclose unusually large, heavy, fragile or special luggage before booking.

Luggage must comply with applicable vehicle, transport and safety requirements.

Bharat Kashi Yatra may refuse carriage of luggage that is:

  • unlawful;
  • dangerous;
  • prohibited under applicable transport rules;
  • likely to damage the vehicle; or
  • likely to create a serious safety risk.

Customers are responsible for keeping track of their belongings.


18. PERSONAL BELONGINGS

Customers should not leave cash, jewellery, electronics, passports, identity documents or other valuable belongings unattended in vehicles, hotels or public places.

The customer is responsible for ordinary care of personal belongings.

Nothing in this clause excludes liability that cannot lawfully be excluded.

If an item is lost in a vehicle, the customer should notify Bharat Kashi Yatra as soon as reasonably possible so that reasonable efforts can be made to locate it.


19. DRIVER AND CUSTOMER CONDUCT

Customers, passengers and drivers are expected to behave lawfully and respectfully.

Violence, threats, harassment, abusive conduct, intentional property damage or serious unsafe behaviour will not be tolerated.

Where reasonably necessary to protect safety or property, service may be discontinued, subject to applicable law and the customer’s statutory rights.

Any legitimate additional cost resulting from intentional customer-caused damage may be recoverable in accordance with applicable law.


20. TOUR ITINERARY

Tour itineraries are prepared based on information and operating conditions available at the time of booking.

The order or timing of sightseeing may change due to:

  • traffic;
  • weather;
  • crowd conditions;
  • road restrictions;
  • temple timings;
  • government directions;
  • local restrictions;
  • attraction closures;
  • safety requirements; or
  • other operational circumstances.

Reasonable itinerary changes do not automatically constitute a deficiency where the material agreed service remains substantially available.

Where a material part of a confirmed service cannot be provided, the customer may contact Bharat Kashi Yatra for an appropriate resolution.


21. TEMPLE, PILGRIMAGE AND RELIGIOUS DESTINATIONS

Temples, ghats, pilgrimage locations and religious sites may operate under rules imposed by:

  • temple authorities;
  • district administration;
  • police authorities;
  • local administration;
  • security agencies; or
  • other competent authorities.

Bharat Kashi Yatra cannot guarantee entry, darshan, VIP darshan, special entry, queue-free access, ritual participation or any other facility unless the same has been expressly confirmed and is legally and operationally available.

No employee, driver, agent or third party is authorised to promise an unlawful or unauthorised facility on behalf of Bharat Kashi Yatra.


22. ENTRY TICKETS AND OPTIONAL SERVICES

Unless expressly included in the booking confirmation, customers may have to pay separately for:

  • monument entry;
  • temple tickets;
  • boat rides;
  • guide services;
  • parking;
  • special darshan;
  • activity fees;
  • attraction tickets;
  • meals;
  • accommodation;
  • local permits; or
  • other optional services.

Customers should rely on the written quotation or booking confirmation for the exact inclusions and exclusions.


23. AIRPORT AND RAILWAY TRANSFERS

Airport and railway transfer services depend upon the customer providing accurate:

  • flight number;
  • train number;
  • arrival/departure time;
  • terminal/station information; and
  • contact details.

Customers should promptly inform Bharat Kashi Yatra about delays, cancellations or schedule changes communicated by the airline or railway.

Where delays result in extended waiting time, additional waiting charges may apply if such charges were disclosed or are reasonably applicable to the booking.


24. FLIGHT, TRAIN AND THIRD-PARTY TRANSPORT DELAYS

Bharat Kashi Yatra does not control airlines, railways, airports, government authorities or independent transportation providers.

Accordingly, delays, cancellations or schedule changes caused by such third parties may affect a customer’s itinerary.

Where possible, Bharat Kashi Yatra may reasonably assist the customer in modifying the associated cab or travel arrangement, subject to availability and applicable charges.


25. HOTEL AND ACCOMMODATION SERVICES

Where accommodation is included, the applicable hotel/property, room category, meal plan and inclusions shall be stated in the booking confirmation.

Hotels may have separate rules regarding:

  • check-in;
  • check-out;
  • identification;
  • security deposits;
  • extra guests;
  • food;
  • property damage;
  • cancellation; and
  • other hotel-specific requirements.

If the originally confirmed accommodation becomes unavailable, reasonable alternative accommodation may be arranged, subject to the booking conditions and applicable law.


26. THIRD-PARTY SERVICE PROVIDERS

Certain services may be fulfilled through independent third-party providers.

These may include:

  • hotels;
  • transport operators;
  • drivers;
  • guides;
  • boat operators;
  • activity providers;
  • restaurants;
  • payment providers;
  • ticketing providers; and
  • other travel suppliers.

Such services may be subject to the third party’s own terms, operating conditions and cancellation policies.

Where Bharat Kashi Yatra is acting as an arranger or facilitator for a third-party service, the applicable third-party terms may apply to that service.

However, this provision does not exclude any liability or consumer remedy that cannot lawfully be excluded.


27. WEATHER, ROAD CONDITIONS AND FORCE MAJEURE

Bharat Kashi Yatra shall not automatically be responsible for delay, modification or inability to perform a service caused by circumstances beyond reasonable control, including:

  • flood;
  • earthquake;
  • severe weather;
  • road closure;
  • traffic restrictions;
  • natural disasters;
  • riots;
  • civil disturbance;
  • strikes;
  • war;
  • government restrictions;
  • public-health emergencies;
  • acts of terrorism;
  • sudden closure of tourist attractions;
  • accidents caused by third parties;
  • major transport disruption;
  • utility or communication failures; or
  • other genuine force majeure circumstances.

Where a force majeure event occurs, reasonable efforts may be made to provide an alternative arrangement.

This clause does not remove any mandatory refund, consumer or statutory remedy that cannot lawfully be excluded.


28. CUSTOMER HEALTH AND MEDICAL RESPONSIBILITY

Customers should inform Bharat Kashi Yatra before booking about any material mobility, accessibility or other travel requirement that may affect the safe provision of a service.

Customers remain responsible for:

  • carrying necessary medicines;
  • following their doctor’s advice where relevant;
  • carrying necessary medical documents; and
  • ensuring that they are fit to undertake the planned journey.

Bharat Kashi Yatra does not provide medical services.

Where a customer requires emergency medical assistance, appropriate local emergency or medical services should be contacted.


29. CHILDREN AND MINORS

Where minors travel as part of a booking, the parent, guardian or responsible adult is responsible for their supervision and for ensuring that required identity and travel documents are available.

All passengers, including children, must comply with applicable safety and passenger requirements.


30. PROHIBITED GOODS AND ACTIVITIES

Customers must not use Bharat Kashi Yatra’s services for unlawful activities.

Customers must not carry or request carriage of items prohibited under applicable law or transport regulations.

Drivers or service providers may refuse carriage of dangerous or prohibited items where reasonably necessary.


31. WEBSITE INFORMATION AND ACCURACY

We make reasonable efforts to ensure that information published on bharatkashiyatra.com is accurate and current.

However, tourism and transportation information may change due to:

  • supplier availability;
  • seasonal conditions;
  • government restrictions;
  • road conditions;
  • attraction timings;
  • operational changes; or
  • other circumstances.

Photographs, vehicle images, destination images and other visual material may be illustrative and may not always represent the exact vehicle, room or location supplied.

For a confirmed booking, the applicable quotation and booking confirmation shall prevail over general website descriptions in case of a specific inconsistency.


32. PROMOTIONAL OFFERS AND DISCOUNTS

Promotional offers may be subject to:

  • limited validity;
  • limited availability;
  • specific destinations;
  • specific vehicle categories;
  • minimum booking requirements;
  • advance-payment requirements; or
  • other conditions stated with the offer.

Promotional pricing shall not be interpreted as a guarantee of unlimited availability.

Bharat Kashi Yatra will not intentionally publish materially false or misleading representations concerning prices, services, quality, availability or benefits.


33. CUSTOMER REVIEWS AND FEEDBACK

Where the website or our communication channels allow reviews, feedback or testimonials, customers must provide genuine information.

Customers must not:

  • manipulate ratings through fraudulent activity;

Unless otherwise stated, the following associated with Bharat Kashi Yatra are protected by applicable intellectual-property laws:

  • logo;
  • website design;
  • original text;
  • photographs owned or licensed by us;
  • graphics;
  • marketing materials;
  • page layouts;
  • branding elements; and
  • other original content.

You may not reproduce, commercially exploit, modify, distribute or publish our proprietary content without prior written permission, except where permitted by law.

Third-party trademarks, logos and content remain the property of their respective owners.


35. PRIVACY AND PERSONAL DATA

Electronic quotations, booking confirmations, invoices, payment records and other communications may be retained as business records, subject to applicable law.

Service-related communications may continue even where a customer has opted out of promotional communications.

Bharat Kashi Yatra will not knowingly ask customers to share unnecessary sensitive financial credentials through ordinary WhatsApp communication.


38. FRAUDULENT OR UNAUTHORISED BOOKINGS

Bharat Kashi Yatra may investigate bookings that reasonably appear to involve:

  • fraud;
  • stolen payment credentials;
  • impersonation;
  • unauthorised transactions;
  • deliberate misuse;
  • fictitious bookings; or
  • other unlawful activity.

Where legally justified, relevant information may be shared with payment providers, law-enforcement agencies or competent authorities.

Genuine customer bookings will not be cancelled arbitrarily merely because a transaction requires ordinary verification.


39. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Bharat Kashi Yatra shall not be liable for indirect, incidental, special or consequential losses arising solely from circumstances beyond our reasonable control.

However, nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

In particular, these Terms do not intend to exclude:

  • fraud;
  • wilful misconduct;
  • liability that cannot legally be excluded;
  • applicable statutory consumer remedies;
  • legally enforceable claims relating to deficiency in service;
  • liability for death or personal injury where exclusion is prohibited; or
  • any other non-waivable legal right.

Any limitation of liability shall be interpreted only to the extent permitted under applicable law.


40. NO WAIVER OF CONSUMER RIGHTS

Nothing contained in these Terms shall be interpreted as:

  • excluding the Consumer Protection Act, 2019;
  • preventing a customer from exercising a statutory remedy;
  • preventing a customer from approaching a competent Consumer Commission;
  • creating an unfair contract;
  • imposing an unlawful penalty;
  • waiving a mandatory consumer right; or
  • excluding a remedy that cannot legally be excluded.

The Consumer Protection Act, 2019 recognises “unfair contract” provisions, including disproportionate penalties, unreasonable charges or conditions and unilateral termination without reasonable cause. Accordingly, these Terms shall always be interpreted subject to mandatory consumer-protection law.


41. COMPLAINTS AND GRIEVANCE REDRESSAL

Customers are encouraged to first contact Bharat Kashi Yatra so that complaints can be reviewed and resolved as efficiently as possible.

Where possible, a complaint should contain:

  • customer name;
  • booking/reference number;
  • date of service;
  • relevant invoice/payment details;
  • description of the complaint;
  • supporting photographs/screenshots/documents; and
  • requested resolution.

Where applicable legal rules prescribe a specific acknowledgement or redressal period, Bharat Kashi Yatra shall comply with the requirements applicable to its business and the relevant transaction.


42. DISPUTE RESOLUTION

Customers are encouraged to contact Bharat Kashi Yatra first for an opportunity to investigate and resolve a dispute amicably.

Where appropriate and legally permissible, the parties may mutually consider:

  • negotiation;
  • mediation; or
  • another lawful dispute-resolution mechanism.

Nothing in this clause prevents a customer from exercising a statutory right to approach a competent authority, Consumer Commission, court or other forum where such remedy is available under applicable law.


43. GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with the laws of India.

Subject to mandatory statutory jurisdiction and consumer-protection laws, courts having lawful jurisdiction in Varanasi, Uttar Pradesh may have jurisdiction over disputes relating to Bharat Kashi Yatra.

Nothing in this clause shall restrict a consumer from exercising any jurisdictional right available under applicable law.


44. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable by a competent authority, that provision shall be modified, limited or severed only to the extent necessary.

The remaining provisions shall continue to operate to the extent permitted by law.


45. NO WAIVER

Failure to enforce any provision of these Terms immediately shall not constitute a permanent waiver of that provision or any other right.


46. CHANGES TO THESE TERMS

Bharat Kashi Yatra may update these Terms from time to time to reflect:

  • changes in services;
  • changes in technology;
  • operational changes;
  • legal or regulatory developments; or
  • changes in business practices.

The latest version shall be published on bharatkashiyatra.com with an updated effective date.

For an already confirmed booking, the booking-specific terms accepted at the time of confirmation shall generally continue to apply, subject to mandatory changes in applicable law.


47. BOOKING-SPECIFIC TERMS PREVAIL

For each confirmed booking, these Terms shall be read together with:

  • quotation;
  • booking confirmation;
  • itinerary;
  • invoice;
  • payment receipt;
  • cancellation/refund conditions;
  • service inclusions/exclusions; and
  • other specific written conditions accepted by the customer.

Where a specific booking term conflicts with a general provision of these Terms, the specific booking term shall apply to that particular service, provided that it does not conflict with mandatory applicable law.


48. ENTIRE AGREEMENT

These Terms, together with the applicable booking confirmation, quotation, invoice, itinerary and other expressly agreed booking-specific conditions, constitute the contractual framework governing the relevant service.

No verbal statement shall intentionally override a written booking condition unless such change is subsequently confirmed by an authorised representative of Bharat Kashi Yatra.

Nothing in this clause prevents rights arising under applicable law.
